On Nov. 5, 2021, OSHA issued an emergency temporary standard (ETS) to implement President Biden’s vaccine mandate. Under this rule, companies with 100 or more employees would be required to ensure all employees are fully vaccinated for COVID-19 or otherwise submit weekly negative tests to enter the workplace. On Dec. 17, 2021, the U.S. Court of Appeals for the Sixth Circuit dissolved the Fifth Circuit’s stay on the ETS. While legal challenges are likely to continue, OSHA and the Department of Labor are moving forward with implementation and enforcement.
